Item type:Publication, Das Rechtsverhältnis zwischen dem Beistand und der Erwachsenenschutzbehörde : insbesondere aus zivilrechtlicher, sozialversicherungsrechtlicher und steuerrechtlicher SichtSince the entry into force of the adult protection law on 1 January 2013, the legal relationship between the deputy and the adult protection authority in the context of carrying out a deputyship has only been partially examined. Aside from providing an overview of the foundations of adult protection law, this doctoral thesis therefore aims specifically to systematically present and examine the legal structure of the relationship between the deputy and the adult protection authority. Through comparison of the legal relationship between the deputy and the adult protection authority with other legally regulated relationships, this thesis explores how this relationship fits into the wider legal order. On this basis, a characterization of the legal relationship between the deputy and the adult protection authority is made. From the insights gained in this manner, further conclusions are then drawn with respect to the applicable rights and duties as well as the collaboration of adult protection authorities and deputies. Finally, utilizing the examination and characterization of the basic relationship between the deputy and the adult protection authority as the departure point, social security and tax law aspects are highlighted. Beyond providing an analysis of the legal relationship, this dissertation is also intended to provide adult protection authorities and deputies with answers to questions in connection with the structure of their legal relationships.Type:doctoral thesis
