In practice, however, there is an increasing need to make use of the English language. At the level of the proceedings before the authority of first instance, a final ruling (final decision) may not be issued in English, as it is subject to the requirement that official languages be used. With regard to submissions in English, isolated exceptions exist under special statutory provisions or international law. The same applies to appeal proceedings. De lege ferenda, a relaxation would be advisable: in order to ensure effective legal protection, submissions in English should, as a rule, be admissible; under certain circumstances, even decisions rendered in English may be conceivable. Item type:Publication, Fristwahrung trotz verspätetem Poststempel?(2025-12-30)This article examines the Swiss Federal Supreme Court's decision 6B_1360/2023 which addresses whether a submission is deemed timely when it was handed over to Swiss Post before the deadline despite being processed and postmarked at a later date. The article provides a systematic analysis of the Court's reasoning on the burden and standard of proof, the admissibility of different forms of evidence, and the evidentiary presumption attached to the postmark. Particular emphasis is placed on cases involving postal collection agreements, where operational processes may delay the official registration of mail.
