Abstract
Article 164 of the Swiss Federal Constitution as well as a number of cantonal constitutions say that important, fundamental or essential provisions must be prescribed by formal law (law passed by the legislature). Determining which legal provisions are important, fundamental or essential poses difficult challenges for legal reasoning, especially if the courts and legal doctrine can not provide sufficient guidelines. This dissertation offers a fundamental orientation on how a convincing legal argument can be achieved even if the constitutional text, previous courts-decisions and legal doctrine do not point to a clear solution. To begin with, it provides an overview on what the requirement of a formal legal basis means according to Swiss constitutional law. Based on observations on the reasoning-methods applied in a leading case of the Swiss federal court particular aspects of legal methodology are then theoretically expounded and later concentratet to singular pieces of advice. Subsequently three pieces of regulation in administrative law are reviewed to see if they conform the requirement of a formal legal basis. This way the previously formulated advice on legal reasoning is illustrated and its applicability put to the test. As a result this dissertation provides an overview on what the requirement of a formal legal basis means, a fundamental orientation on the method of argumentation necessary to substantiate that requirement as well as impulses and suggestions for future application in select areas of Swiss administrative law.

Art. 164 der Bundesverfassung sowie mehrere Kantonsverfassungen schreiben vor, dass wichtige, grundlegende oder wesentliche Bestimmungen in einem formellen Gesetz zu regeln sind. Die Ermittlung dessen, was wichtig, grundlegend oder wesentlich ist, stellt die Jurisprudenz vor anspruchsvolle Begründungsprobleme, vor allem dann, wenn Rechtsprechung und Lehre keine ausreichende Orientierung geben können. Diese Dissertation gibt grundlegende methodische Orientierung darüber, wie überzeugende rechtliche Begründung erarbeitet werden können, selbst wenn der Verfassungstext sowie die Rechtsprechung und die Lehre keine klare Lösung aufzeigen. Sie enthält zunächst einen Überblick zum Gehalt des Erfordernisses der Gesetzesform nach schweizerischem Verfassungsrecht. Anhand von Beobachtungen zur Begründungsmethode eines bundesgerichtlichen Leitentscheids werden sodann einzelne Aspekte der juristischen Methodenlehre theoretisch vertieft und zu kurzen Begründungsratschlägen zusammengefasst. Anschliessend werden drei ausgewählte Normen aus dem schweizerischen Verfassungsrecht darauf hin überprüft, ob sie vor dem Erfordernis der Gesetzesform standhalten oder nicht. Dadurch werden die zuvor erarbeiteten Begründungsratschläge veranschaulicht und ihre Tauglichkeit wird getestet. Im Ergebnis liefert diese Dissertation einen rechtsdogmatischen Überblick zum Gehalt des Erfordernisses der Gesetzesform, eine grundlegende Orientierung über die Begründungsmethode zur Konkretisierung des Erfordernisses der Gesetzesform sowie Denkanstösse und Vorschläge zur Handhabung des Erfordernisses der Gesetzesform in ausgewählten Gebieten des schweizerischen Verwaltungsrechts.
