Abstract
This intervention is part of a broader effort by InternetLab to qualify the public debate around platform regulation, intensified by the proposal of the "Brazilian Law on Internet Freedom, Responsibility and Transparency", approved by the Senate at the end of June 2020. Our concern is that this project, designed for large platforms, will end up impacting the functioning of others due to its broad scope - which includes the adoption of a comprehensive concept of social network. In this document, we provide reflections and considerations on the dynamics of the functioning of what we call "knowledge platforms", such as Wikipedia, the Internet Archive and GitHub. It's common for the regulatory discussion to be centered on what we call commercial platforms - and it's no different in the debate taking place around the bill at the moment. However, the internet is made up of a diverse ecosystem. If this diversity is not taken into account, there is a risk that a certain rule, designed for one context, will be applied in another, with unpredictable and unwanted consequences. Here, we point out particularities of these platforms that show that the debate is not being held with them in mind - and that, to preserve their existence and power, they should be explicitly excluded from the scope of this regulation. We also point out how a similar discussion took place around the European Union's Copyright Directive, culminating in these platforms' exclusion from the regulatory scope.
