Abstract
The role of judges in the highest courts is crucial in the European human rights mechanism. The European Court of Human Rights (ECHR) must rely on the opinions of the highest national courts in interpreting the Convention, taking into account the specific circumstances in each Member State. This means that before an application is made to the ECtHR, national authorities should have the opportunity to address alleged human rights violations. The ECtHR must be able to refer to national courts in its judgments, as it relies on their opinions in interpreting the Convention in the context of each Member State. It is therefore important to define precisely the procedural tasks assigned to the supreme courts, which include remedying violations of the Convention in the domestic context.
